1. Acceptance of terms

By accessing or using popx.tools (the “Site”) or the POPX software (the “Software”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site or the Software.

These Terms form an agreement between you and Yuval Cohen (operating as Mini UV), the creator and rights holder of POPX (“we”, “us”).

2. Software license

POPX is proprietary software. An active subscription grants you a non-exclusive, non-transferable, revocable license to use the Software according to the terms below.

You are allowed to

  • Use POPX in commercial and non-commercial projects, including shows, installations, videos, advertisements, and client work.
  • Modify POPX internally for your own workflow and personal use.
  • Use POPX inside TouchDesigner on any machine you personally own or control.
  • Keep using any version of POPX you downloaded during an active subscription, even after the subscription ends, subject to the rest of these Terms.

You are NOT allowed to

  • Redistribute, copy, upload, mirror, or share the POPX .tox file, any of its components, internal networks, GLSL shaders, or source code.
  • Use any part of POPX’s code (GLSL, logic, operators, or structures) to create derivative tools, plugins, products, or systems intended for sale or commercial release.
  • Sell, sublicense, or commercialize any software or tool based on or derived from POPX.
  • Publish modified versions of POPX, even for free.
  • Share your account credentials, or use a single subscription to provide POPX to multiple individuals at different studios or households.
  • Reverse-engineer, decompile, or attempt to extract source from compiled or encrypted components.

3. Access and subscriptions

POPX operator downloads and premium content are available to supporters at the Advanced tier of patreon.com/c/_mini_uv. All payment, billing, refunds, and subscription management is handled by Patreon under Patreon’s terms. We do not store payment data.

4. Accounts

You must provide accurate information when creating an account and keep it current. You are responsible for activity that occurs under your account and for safeguarding your sign-in credentials. You must be at least 16 years old to create an account.

We may suspend or terminate accounts that violate these Terms, the Acceptable Use Policy, or applicable law. For serious violations (e.g. redistribution of POPX), termination is immediate and without refund.

5. Software updates

POPX is provided “as is” and is under continuous development. Active subscribers receive new versions and updates as they are released. Features may be added, changed, or removed between versions, and we do not guarantee that any particular feature will remain available indefinitely.

6. TouchDesigner dependency

POPX is a plugin designed exclusively for TouchDesigner, developed by Derivative Inc. POPX relies entirely on TouchDesigner’s runtime, rendering engine, and underlying systems to function. As a result:

  • Bugs, limitations, or changes within TouchDesigner may directly affect POPX functionality and performance.
  • POPX compatibility depends on the TouchDesigner version you are running.
  • We are not responsible for issues caused by TouchDesigner itself, by changes in TouchDesigner releases, or by platform-specific limitations of your system.
  • You are responsible for running a supported TouchDesigner build as specified in the changelog or system requirements for the POPX version you are using.

7. Disclaimer of warranties

The Site and the Software are provided “as is” and “as available”, without warranty of any kind, whether express, implied, statutory, or otherwise. We do not warrant that POPX will be error-free, uninterrupted, secure, or compatible with all systems, projects, or workflows. As a TouchDesigner plugin, POPX inherits any limitations or issues present in the host application. Use of POPX is at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, in no event will Yuval Cohen, Mini UV, or POPX be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or project losses, arising out of or relating to your use of the Site or the Software, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to these Terms, the Site, or the Software is limited to the amount you paid us (or, for Patreon-bridged accounts, the amount Patreon paid us on your behalf) in the twelve (12) months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising out of (i) your breach of these Terms, (ii) your misuse of POPX, or (iii) any content you create or distribute using POPX in violation of third-party rights or applicable law.

10. Changes to these terms

We may modify these Terms from time to time. The current version is always posted on this page with an updated “Last updated” date. Material changes will be announced via email or on the Site. Continued use of the Site or Software after the effective date constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of Israel, without regard to its conflict-of-laws rules. Mandatory consumer-protection rights you have in your country of residence are not affected.
